Second working contract

The Austrian newspaper DERSTANDARD cited in a publication on March 28th 2024, how to apply this EU leg. 2019/1052 on second working contracts. §2i of the Austrian Arbeitsvertragsrechts-Anpassungsgesetz ("AVRAG") however, still allows the employer to forbid this if such a second contract would lead to excessive working time beyond the allowed fulltime working hours imposed by the Austrian law AND/OR if a second working contract compromises the productivity of the existing one.

So where is the WIN-WIN-WIN situation?

Imagine the Austrian medical sales rep ANTON visiting physician offices and hospitals to promote product A for his employer. The new and innovative product B from another manufactuerer is launched but there is no sales force available to promote it locally. Product B could be used/prescribed complementary to product A. ANTON could substantially increase his popularity with co-promoting product B in his sales calls. Advice to ANTON: convince your employer to accept your second working contract under AVRAG §2i. You increase your popularity and ideally you may increase your income with going the extra mile in your conversation. Your customers would appreciate your efforts to bring about innovative products quicker.
